Terms of Service

These terms explain the rules for using Rememberkin, creating and sharing family projects, using AI features, and purchasing personalized products.

1. Acceptance of these terms

These Terms of Service govern your access to and use of Rememberkin, a service operated by Rememberkin LLC, including our website, accounts, design tools, family-history workflows, digital features, products, and related services.

By accessing or using Rememberkin, you agree to these terms and our Privacy Policy. Additional terms presented for a specific feature, promotion, or purchase also apply. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old to use Rememberkin. If you are under the age of legal majority where you live, you may use the service only with the permission and supervision of a parent or legal guardian who agrees to these terms. You must be legally capable of entering into a binding agreement to make a purchase.

3. What Rememberkin provides

Rememberkin helps people import, organize, edit, share, and turn family-history information into personalized experiences and products. Current features may include printed books, charts, framed or unframed wall art, enhanced or animated photos, AI-assisted stories, digital previews, collaboration, share links, gifts, and purchase credits.

Features, product specifications, prices, availability, and supported providers or shipping regions may change. We may add, modify, suspend, or discontinue a feature, and some features may be identified as experimental or unavailable for purchase.

4. Accounts and connected services

Some parts of Rememberkin are available without a full account, but project creation and other features require you to sign in or connect a third-party account. You agree to provide accurate information, keep your access methods secure, and promptly notify us of suspected unauthorized use.

If you connect FamilySearch or another external service, you authorize Rememberkin to access and use the information you permit that service to provide so we can perform the features you request. Your use of an external service is also governed by its own terms and privacy policy, and you are responsible for maintaining any account or permissions it requires.

Rememberkin is an independent service and is not FamilySearch. We do not control third-party data, permissions, accuracy, availability, or account decisions.

5. Orders, pricing, payment, and credits

Prices, product and feature availability, promotions, taxes, shipping methods, and delivery estimates may change. The price and terms shown when you submit an order apply to that purchase. We may correct errors, reject an unsupported configuration or destination, or cancel and refund an order affected by a material mistake or inability to fulfill it.

You agree to provide current, complete, and accurate billing, contact, and shipping information. Stripe processes card payments, and payment is subject to Stripe's terms. Physical products are currently available only to supported United States shipping addresses.

Promotional, purchased, or gifted credits may be used only for eligible Rememberkin purchases and have no cash value except where required by law. Feature-specific credit costs and any additional conditions shown when credits are issued or used are part of these terms. You are responsible for safeguarding gift and claim links; the person who validly claims a bearer-style gift link receives the associated credit.

6. Cancellations, returns, and refunds

Every printed Rememberkin product is personalized and made to order. You may cancel an eligible physical order for a full refund before it is submitted to a print provider. Once production begins, it cannot be canceled, returned, or refunded except where required by law.

If a physical order arrives damaged or with a printing defect, contact us within 30 days after delivery with your order number and evidence of the issue. If the request qualifies, we will provide a replacement at no additional cost. Other refund or replacement requests must also be made within 30 days after delivery.

Digital products and consumed digital or AI-generation credits are delivered or used immediately and are not returnable. If a digital result fails because of a service error, contact us and we will review the issue. Our Returns & Refunds policy contains the current operational details and is incorporated into these terms.

7. Your content and permissions

You retain any ownership rights you have in the family data, text, photos, documents, edits, and other content you submit, upload, connect, import, or create. Rights held by FamilySearch, contributors, photographers, relatives, archives, or other original sources are not transferred to you or to Rememberkin.

You grant Rememberkin a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, analyze, adapt, display, transmit, and otherwise process your content only as reasonably necessary to operate and secure the service; provide requested editing, sharing, AI, printing, fulfillment, and support features; and comply with law. This license includes allowing our service providers to process the content for those purposes.

You represent that you have the rights, permissions, consents, and lawful basis needed to provide and use your content, including information and images of living people, and to authorize the processing described in these terms and the Privacy Policy. You are responsible for the accuracy, legality, and appropriateness of your content and for reviewing a project before ordering or sharing it.

8. Collaboration, links, and gifts

Project owners can invite other people as viewers or editors. Editors may change shared content, and viewers may see the content available in the project. You are responsible for choosing recipients and roles, managing access, and understanding that removing access does not retrieve copies already made.

Some share links display a public preview or allow a recipient to copy matching finished content into a separate project based on the recipient's own family tree. Anyone who obtains an active link may be able to use it, and copied projects do not remain synchronized with the original. Gift and claim links may likewise be usable by whoever possesses them.

Do not share a project, invitation, gift, claim, asset, or preview link with anyone you do not want to receive the information or benefit it exposes. You are responsible for disclosures you initiate through the service.

9. AI and automated features

Rememberkin may use automated image analysis and third-party AI models to detect and compare faces, estimate attributes, recommend photos or crops, enhance or animate images, rank source material, and draft stories. These tools produce estimates and generated material, not verified historical facts.

AI output may be inaccurate, incomplete, unexpected, or similar to material produced for other users. You must review outputs before relying on, publishing, gifting, or printing them. Rememberkin does not guarantee that an enhancement will preserve identity or historical details, that an animation will be authentic, or that a drafted story will be factually complete.

You may not use AI or automated features to violate another person's rights, create deceptive or unlawful material, or process content you are not authorized to provide.

10. Project deletion

When you delete an eligible project, it moves to Trash and can ordinarily be restored for approximately 90 days. After that period, it is permanently deleted from active systems through our deletion process. Projects tied to placed orders cannot be deleted while they are needed to fulfill or support those orders.

Deleting a source project does not delete an independent project another user created from shared content, an immutable order snapshot, transaction or fulfillment records, content another user separately provided, or information controlled by FamilySearch or another third party. Limited copies may also remain where required for security, backups, disputes, or legal compliance.

11. Acceptable use

You may not use Rememberkin in a way that is unlawful, fraudulent, abusive, harmful, or disruptive, or that violates another person's rights or privacy.

  • Access or attempt to access another person's account, project, connection, order, or non-public system without authorization.
  • Reverse engineer, probe, disrupt, overload, scrape, or circumvent security, rate limits, access controls, or product restrictions, except where applicable law expressly permits it.
  • Upload malware, infringing material, intimate or exploitative content shared without consent, or content that violates law or another person's intellectual-property, publicity, or privacy rights.
  • Use the service or its output to impersonate, defraud, harass, mislead, or harm another person, or to create or distribute illegal material.
  • Resell, sublicense, or commercially exploit the service or access it through automated means without our written permission.

12. Rememberkin intellectual property

Rememberkin and its licensors own the service, including its software, design, branding, templates, text, graphics, workflows, and underlying technology. These terms do not transfer ownership of your content to us, and they do not give you any right to use Rememberkin trademarks, source code, or proprietary materials except through the service as intended.

If you voluntarily provide feedback or suggestions, you grant us permission to use them without restriction or compensation, provided we do not identify you publicly without permission.

13. Third-party services and materials

Rememberkin relies on and may link to third-party services for authentication, family data, hosting, storage, analytics, AI processing, payment, email, printing, and shipping. We do not control and are not responsible for third-party services, content, policies, decisions, errors, or ongoing availability.

Third-party family-history records, memories, images, and source documents may be inaccurate, incomplete, restricted, or removed. You are responsible for evaluating source information and complying with source and license requirements, including attribution where applicable.

14. Disclaimers

Rememberkin is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment.

We do not guarantee that the service will be uninterrupted, secure, or error-free; that imported, analyzed, or generated family-history content will be complete or accurate; that third-party data or services will remain available; or that a digital preview will exactly reproduce every physical variation in printing, materials, color, cropping, or framing.

15. Limitation of liability

To the fullest extent permitted by law, Rememberkin and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the service.

To the fullest extent permitted by law, the total liability of Rememberkin for claims arising out of or relating to the service will not exceed the greater of the amount you paid to Rememberkin for the specific product or service giving rise to the claim during the twelve months before the claim arose or one hundred U.S. dollars.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the provisions above may not apply to you.

16. Governing law and disputes

These terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules.

Any legal action that is not required to be brought elsewhere by applicable law must be brought in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally.

17. Suspension and termination

We may suspend or terminate access, remove content, or restrict a feature if we reasonably believe you violated these terms, created risk or harm, exposed us or others to legal liability, failed to pay an amount due, or misused the service. Where reasonable, we will try to provide notice and an opportunity to address the issue.

You may stop using the service at any time. Provisions that by their nature should survive will remain effective, including provisions about content permissions needed for retained records, ownership, disclaimers, liability, disputes, and amounts owed.

18. Changes to these terms

We may update these terms as Rememberkin changes. We will post the revised terms on this page and update the "Last updated" date. If a change is material, we may provide additional notice where appropriate or required by law. Unless stated otherwise, revised terms apply when posted; changes do not retroactively alter an order already submitted.

19. General terms

These terms, the Privacy Policy, the Returns & Refunds policy, and any feature- or order-specific terms form the agreement between you and Rememberkin about the service. If one provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these terms without our written consent; we may assign these terms in connection with a reorganization, financing, merger, acquisition, or sale of the business.
